1. Introduction and Agreement to Terms

Welcome to Prime Legacy Mortgage Group, LLC ("Company", "we", "us", or "our"). 3. Eligibility Requirements

The Services are intended solely for users who are eighteen (18) years of age or older. By using the Services, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

4. User Responsibilities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

In any way that violates any applicable federal, state, local, or international law or regulation.

To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm the Company or users of the Services or expose them to liability.

You are responsible for ensuring that all information you provide to us is accurate, current, and complete.

5. SMS/Text Messaging Program Terms and Conditions

Prime Legacy Mortgage Group, LLC offers a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and Conditions and Privacy Policy. By opting in to or participating in any of our Programs, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with us through binding, individual arbitration, as detailed in the "Dispute Resolution" section below.

5.1. Program Description and Use Cases

Users that opt-in to the Program can expect to receive messages regarding the marketing, promotion, and processing of residential mortgage loans. Messages may include:

ALERTS: Notifications about significant changes to interest rates, updates on your application status, and important account-related alerts.

PROMOTIONS: Marketing messages containing special mortgage rate offers, limited-time deals, and promotional campaigns relevant to your financial interests.

NOTIFICATIONS: Reminders to submit required documentation, appointment reminders, closing date notifications, and deadline alerts.

LOAN UPDATES: Real-time updates regarding the processing status of your loan, underwriting updates, conditional approvals, closing confirmations, and milestone achievements.

5.2. User Opt-In

The Program allows users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through online enrollment forms or application processes. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program.

5.3. Cost and Frequency

Message and data rates may apply. The frequency of messages sent may vary depending on the status of your loan application and your interaction with our Services. Check your mobile plan and contact your mobile carrier for details on your messaging and data rates.

5.4. Supported Carriers

Supported carriers may include, but are not limited to: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

5.5. Opt-Out Instructions

If you wish to withdraw your consent and stop receiving text messages from us, you may reply with the keyword STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message you receive from us. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out.

5.6. Help Instructions

For assistance, reply with the keyword HELP to any mobile message you receive from us, or contact us at [email protected].

5.7. Age Restriction

You must be at least 18 years of age to use the SMS service. By signing up for the Program, you confirm that you are 18 years of age or older.

6. Privacy Policy Reference

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Services and explains how we collect, use, and share your information. Our Privacy Policy is incorporated by reference into these Terms.

7. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PRIME LEGACY MORTGAGE GROUP, LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

8. Limitation of Liability

IN NO EVENT WILL PRIME LEGACY MORTGAGE GROUP, LLC, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

9. Governing Law

All matters relating to the Services and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Georgia without giving effect to any choice or conflict of law provision or rule.

10. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
